Sample Publishing Agreement
Author Right to Ownership
Under this agreement, the author grants ADVANTAGE BOOKS, INC. limited, nonexclusive rights to print and distribute the Work only. ADVANTAGE BOOKS, INC. acquires no right of ownership to the Work under this agreement, and all publishing rights are reserved to the Author.
Author Right to Copyright
ADVANTAGE BOOKS, INC. acknowledges the Author shall own full and complete copyright to the work. In order to protect the Author’s full right to privacy and ownership in the Work, ADVANTAGE BOOKS, INC. guarantees not to contact the U.S. Copyright Office on the Author’s behalf.
Term and Termination
The Author may cancel this agreement at any time with a written 30 day notice. The author may enter into another publishing agreement for this Work at any time. ADVANTAGE BOOKS, INC. shall not, however, refund to the Author any portion of the submission fee in the event the Author cancels this agreement or enters into another agreement for this Work.
This agreement shall extend for three (3) years after the date ADVANTAGE BOOKS, INC. releases the Work for publication, and then it will automatically renew for consecutive one (1) year terms if neither parties gives at least thirty (30) days written notice, prior to the end of the current term, that it desires to terminate.
Distribution
ADVANTAGE BOOKS, INC. intends to prepare the Work for on-demand distribution within ninety (90) days of the date of this Agreement, but the author acknowledges that the production process may exceed that time period due to circumstances beyond its control. ADVANTAGE BOOKS, INC. also agrees to secure a unique ISBN (International Standard Book Number) for the Work.
Author Warranties
The author guarantees he/she is the sole owner of the Work and has full authority and right to enter into this agreement. The Author guarantees the Work is original and does not infringe upon any laws or rights, and that the Work is not libelous, plagiarized or in any other way illegal. If any portion of the Work is fictitious, the Author guarantees it does not represent any real event or person in any way that could be deemed libelous. ADVANTAGE BOOKS, INC. assumes no responsibility for reviewing the editorial content of the Work.
Author Indemnification
The Author agrees to fully indemnify, defend and hold harmless ADVANTAGE BOOKS, INC., its employees, owners, and/or its affiliates against all manner of claims, losses, damages, judgments, settlements, or expenses (including legal fee’s) it sustains in connection with any breach or alleged breach of the representations set forth above, or in connection with claims by any third party regarding ownership, libel, slander, plagiarism, or privacy.
Terms of Sale
The Author is not required to purchase copies of the Work. The author may purchase copies of the Work in any quantity. Orders must be paid for with check or money order (made out to ADVANTAGE BOOKS, INC.), or credit card, at the time the order is placed. Orders of less than one-hundred (100) copies shall be printed and shipped within five (5) to ten (10) working days from receipt of order. Orders of one-hundred (100) to nine-hundred ninety nine (999) copies may take an additional ten (10) working days to print and ship.
Orders of one-thousand (1,000) or more will take twenty-five (25) to thirty (30) working days from receipt of order to print and ship. All orders shipped via United Parcel Service (UPS). The Author agrees to pay ADVANTAGE BOOKS, INC. the actual UPS Shipping charges for each order, plus handling fee of $1.50. The publisher shall grant authors a minimum discount off the retail price of their book as follows: thirty percent (30%) discount for Silver Program, forty percent (40%) discount for Gold Program, or fifty percent (50%) for Platinum Program. The publisher may occasionally offer discounts up to sixty-five percent (65%) off the retail price for bulk orders. Authors shall receive no royalties on copies they purchase. Royalties are paid only on copies sold to bookstores, libraries, or directly to consumers.
Cover Design
ADVANTAGE BOOKS, INC. will consider Authors suggestions, but does not guarantee it can perform any unusual or special request. The Author acknowledges that
ADVANTAGE BOOKS, INC. does not create original drawings, painting, photographs or illustrations. The Author also acknowledges that colors viewed on a computer monitor or hard copy printed from a computer printer may not reflect actual colors on the final printed book. Further, the Author acknowledges that the cover color may vary between print runs. Under no circumstance shall ADVANTAGE BOOKS, INC. refund, reimburse, or otherwise replace books printed with cover errors or color variance.
Text Format
ADVANTAGE BOOKS, INC. reserves the right to determine the manner and style in which the Work will be formatted and typeset, using styles that are consistent with popular trade books, using Times New Roman font. The Author acknowledges that ADVANTAGE BOOKS, INC. cannot guarantee it will perform any special or unusual formatting requests. The Author also acknowledges that ADVANTAGE BOOKS, INC. cannot create an index for the work, and that ADVANTAGE BOOKS, INC. cannot accommodate footnotes, only end of chapter or end of book endnotes. The Author acknowledges that from time to time, errors may occur in the typesetting process. ADVANTAGE BOOKS, INC. shall perform one round of corrections to correct errors proven by the author, at no cost to the author. But under no circumstance shall ADVANTAGE BOOKS, INC. refund, reimburse, or otherwise replace books printed with such errors.
Miscellaneous Fees
All manuscripts are to be submitted to ADVANTAGE BOOKS, INC. in complete and final form (already edited, copy edited and proofread). {After submission, if the Author requests any minor changes to the Work (i.e. spelling, punctuation, replacing a word), ADVANTAGE BOOKS, INC. shall allow up to ten (10) minor changes without fee, but shall charge fees starting at $50 plus $2 per minor change thereafter. The Author acknowledges that the Publisher may alter or change miscellaneous publishing fees at any time. Two (2) to three (3) weeks will be added to the production schedule for the work for each text galley or cover comp beyond the initial galley or cover comp. If an author cannot or chooses not to receive text galleys and over comps via email, hard copy versions can be mailed to the author for a fee. Two (2) to three (3) weeks will be added to the production schedule if text galleys or cover comps are mailed to the Author. (Fees are subject to change without notification.)
Graphics
The Author may submit graphics in the form of tables, charts, black and white photographs, drawings, or other illustrations. ADVANTAGE BOOKS, INC. shall charge a fee of fifteen dollars ($15.00) per graphic on disk, submitted on acceptable form (see ADVANTAGE BOOKS, INC.’s Text & Graphics Guidelines). Graphics not on disk cost twenty-five dollars ($25.00) each and must be submitted in scan-able form, properly sized.
All fees are payable upon execution of this Agreement. All graphics submitted with the Work must comply with ADVANTAGE BOOKS, INC.’s Text & Graphics Guidelines. Please be advised that ADVANTAGE BOOKS, INC. will place these graphics with appropriate captions provided by the author. (Fees are subject to change without notification).
Publisher Discretion
ADVANTAGE BOOKS, INC. shall have the discretion to determine the retail price, production, format, and appearance of the Work. The format and appearance of the Work may vary between printings. Retail prices are subject to change, but under no circumstance may the Publisher increase the price of the Work by more than one dollar ($1) per annum, after the end of the first year of the publication of the Work, ADVANTAGE BOOKS, INC. will charge the Author an annual maintenance fee of twenty-four dollars and ninety-nine cents ($24.99) to keep the Work in print and available for distribution.
ADVANTAGE BOOKS, INC. reserves the right to remove the ADVANTAGE BOOKS, INC. logo from any book when deemed necessary by the Publisher. ADVANTAGE BOOKS, INC. also reserves the right to decline to publish or revise any book.
Publishing Program
ADVANTAGE BOOKS, INC. shall publish the Work according to the terms and conditions set forth in the SILVER ADVANTAGE™, GOLD ADVANTAGE™ and PLATINUM ADVANTAGE™ publishing programs. ADVANTAGE BOOKS, INC., reserves the right to revise, replace or update distribution, promotional or marketing initiative as necessary or due to circumstances beyond its control. Any royalties due which are less than twenty-five dollars ($25) in any one quarter shall be carried over and payable in the next accounting quarter.
Damage or Loss of Materials
ADVANTAGE BOOKS, INC. shall endeavor to care for and return any disks, manuscripts, photographs, or artwork, but is not responsible for any damage or loss.
Law and Venue
The parties understand this agreement is binding upon their heirs, executors, administrators, and assigns. This agreement supersedes other oral or written agreements, and cannot be changed or modified except by the mutual written agreement of ADVANTAGE BOOKS, INC. and the author. The laws of the state of Florida shall govern this agreement.
